Subject: HR 1907 -- INSIST ON FULL DEBATE

Dear Wayne --

I just got some e-mail on a thread that originated from you. It may have started based on comments that I made to you before I requested that you remove me from your distribution list.

If I am one of the "others" whom you claim (unjustly) accused you of "fast tracking" HR 1907, please let me set the record straight. What I think, and what I think that I said to you, was that you are ATTEMPTING TO RUSH THIS CRUCIAL LEGISLATION THROUGH CONGRESS WITHOUT THE EXTENSIVE DEBATE THAT I, A QUORUM OF AMERICA'S NOBEL LAUREATES, AND MANY OTHER CITIZENS HAVE REQUESTED.

I object to that. I object to ANY tactics that rush this bill, or that prevent a FULL DEBATE on the issues surrounding this bill. Our patent system is generally agreed to be the best in the world. It has been doing its job for over 200 years. Why should we rush to change it? (Dana knows the "submarine patent issue" is bogus. He has so stated in the past.)

I also object to the fact that you represent HR 1907 as a compromise bill and imply -- or, worse, state -- that no one of consequence objects to it. Title VI alone would convert the PTO Director into a "Technology Czar" and effectively remove the PTO from oversight. I strongly object to that. Many object to that.

That is a "big deal," Mr. Paugh. It is a BIG deal because the Czar can bypass virtually all of the normal government checks and balances. This extends to purchasing, salaries, bonuses, GIFTS, and to going outside of the US for things he should NOT do. This has been the BIG push FROM THE BEGINNING of this kind of legislation. Getting the PTO out of the normal government oversight will let the Czar do ANYTHING he wants with the patent office. I oppose that, strongly.

Yes, HR 1907 is more covert about this removal of oversight than were HR 400 and HR 3460, but we STILL get a Czar with almost unlimited powers and a PTO removed from effective oversight. Congress allowed the IRS to run without oversight, and it caused grievous harm. Congress failed to provide oversight and buried its collective heads in the sand when our nuclear secrets were being stolen, and it caused grievous harm. Does Dana REALLY want to repeat these errors with the PTO?

PLEASE ASK DANA TO SEND HR 1907 BACK TO COMMITTEE. ASK FOR SIMPLIFICATION OF THE BILL AND FOR FULL DEBATE ON TITLE VI. PLEASE TELL DANA THAT THOSE WHO SUPPORTED HIM IN THE PAST REQUEST A FULL DEBATE ON HR 1907.
